Terms & Conditions

(1) Introduction

These terms and conditions govern your use of our website; by using our website, you accept these terms and conditions in full.If you disagree with these terms and conditions or any part of these terms and conditions, you must not use our website.

(2) Ordering

You can order online by clicking the "Add to Cart" button next to the item you wish to purchase (you can always remove the item from your order later) and when you have completed shopping, click the "View Cart" button which takes you to our secure checkout via PayPal. You may then enter your delivery and billing information and credit card details and submit your order via the secure server. Alternatively, if you'd prefer to place your order over the phone you can call a member of our sales team on (0044) 020 8543 7721 (lines open 9am until 3pm Monday to Friday).

(3) Delivery

The prices shown on our website do not include delivery unless specified. You will be offered options and costs at checkout including 'Next Day Delivery'. This can be done by navigating to http://www.firstholycommunion.co.uk/specialdelivery and adding special delivery to your cart.

Orders

Once an order has been placed it will be processed and despatched within 24 hours and delivered to you by Royal Mail.

Orders placed on Friday, Saturday or Sunday will be processed and despatched on the next working day and delivered to you by Royal Mail.

Guaranteed Next Day Delivery

We offer a guaranteed next day delivery service at your home or place of work. If we receive your order prior to 12 midday Monday to Friday your order will be delivered before 1pm the next working day. Orders placed on Saturday or Sunday will be delivered by 1pm on Tuesday.

Guaranteed Saturday Delivery

We offer a guaranteed Saturday delivery service at your home or place of work. If we receive your order by 12 midday on a Friday, your order will be delivered before 1pm the next day.

Please be aware that Guaranteed next day delivery requires a signature upon receipt.

(4) Payment

We currently accept payment via PayPal. PayPal is the safer, easier way to pay online. The service allows anyone (with or without a PayPal account) to pay in any way they prefer, including through credit cards, bank accounts, buyer credit or account balances, without sharing financial information.

(5) Refusal of Transaction

We reserve the right to withdraw any products from this website at anytime and/or remove or edit any materials or content on this website. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any product from this website whether or not that product has been sold; removing or editing any materials or content on the website; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

(6) Change of Heart

Goods returned to us because of a change of heart must be unused and in perfect, re-saleable condition (including product packaging, instructions, etc), otherwise no refund. Please note that the costs of returning item(s) to us as a result of a change of heart must be borne by you. In any event, the item(s) must be returned within 7 days of purchase. Under the European Distance Selling Regulations (DSRs), customers in the European Union that cancel a contract for purchase of an item(s) within 7 days of receipt of their order will receive a refund for the cost of the item(s).

(7 )No Quibble / “Cooling Off” Period

Our returns policy is simple! Our "no quibbles" guarantee means that if for any reason you are unhappy with your purchase, i.e. the item you have ordered is faulty, defective or you've had a change of heart (which is fair enough) you must return it to us unused and in its original condition within 7 days for a prompt replacement, exchange or refund.

(8) Faulty or defective items

If you return an item because of an error on our part, or it is defective, we will happily refund your costs in returning it to us.

(9) Cancelled Orders

An order may be cancelled at any time between the placement of the order and 7 working days following delivery of the goods. If you are dissatisfied with your purchase for any reason you may, within seven working days of delivery, contact our Customer Service department to notify us that you wish to return some or all items from your order. You have to arrange to return the goods to us yourself at your own cost. Goods must be returned in the same condition they were in at the time of delivery and in their original packaging. Refunds will be issued within 30 days of receipt of goods and after we have inspected them for damage.

(10) Returns

You may return any sold by www.firstholycommunion.co.uk within 7 days of delivery for a refund. Items should be returned in their original product packaging. You will have to arrange and pay the return shipping costs for the items, except if the return is a result of our error. Just visit our online FAQ’s and we will guide you through the process of returning good to us. Any item that is not in its original condition, is damaged, or is missing parts for reasons not due to our error after inspection will be eligible for a partial refund of up to 50% of item's price.

(11) Refunds

We will activate a refund after we receive and process your return. For returned items you can expect your refund within 30 days (though in the majority of cases you'll receive the refund sooner).

• This time period includes:

• 5 to 7 business days for us to receive your return from the shipper

• 3 to 3 business days for us to process your return

• The time it takes your bank to process our refund request (see below for specific guidelines)

We will notify you via e-mail of your refund once we've received and processed the returned item.

(12) Exchanges

If you received a faulty item and need to exchange it for the same item, visit our online FAQ’s and we will guide you through the process of requesting a replacement with us. If you would like to exchange an item for a different one, please visit our online FAQ’s and we will guide you through the process of exchanging goods to us and place another order for the item you wish to purchase. You do not have to wait for us to receive the original item before placing the new order.

Please note that it takes us 3 to 5 business days to process returns once they arrive back to our warehouse.

(13) Perishable Goods

We are unable to accept returns of perishable goods.

(14 )Returned Items lost in Transit

We cannot be held responsible for packages lost in transit: as you are responsible for returning the item(s) to us, we recommend sending the package by Recorded/Special Delivery.

(15) Complaints Procedure

www.firstholycommunion.co.uk takes its relationships with customers very seriously, and we expend a great deal of effort ensuring that we keep you happy. We aim to reply to emails within one working day of receipt, whether they're enquiries or complaints. If email is too impersonal, you can phone us on 020-8543-7721, where our customer support team will gladly be of assistance. All your feedback is appreciated.

(16) Governing Law and Contract Formation

The technical steps required to create the contract between you and us are as follows:

•You place the order for your products on the website by pressing the"submit" button at the end of the check-out process. You will be guided through the process of placing an order by a series of simple instructions on the website.

•Order acceptance and the completion of the contract between you and us will take place on the dispatch to you of the products ordered unless we have notified you that we do not accept your order or you have cancelled it.

Non-acceptance of an order may be a result of one of the following reasons:

• The product(s) you ordered being unavailable from stock

• Our inability to obtain authorization for your payment

• The identification of a pricing, product or offer description error

• You not meeting the eligibility to order criteria as set out below

Unless otherwise stated, we own the intellectual property rights in the website and material on the website. Subject to the licence below, all these intellectual property rights are reserved.

Access to certain areas of our website is restricted. We reserve the right to restrict access to other areas of our website, or indeed our whole website, at our discretion.

If we provide you with a user ID and password to enable you to access restricted areas of our website or other content or services, you must ensure that that user ID and password is kept confidential.

We may disable your user ID and password in our sole discretion without notice or explanation.

In these terms and conditions, “your user content” means material (including without limitation text, images, audio material, video material and audio-visual material) that you submit to our website, for whatever purpose.

You grant to us a worldwide, irrevocable, non-exclusive, royalty-free licence to use, reproduce, adapt, publish, translate and distribute your user content in any existing or future media. You also grant to us the right to sub-license these rights, and the right to bring an action for infringement of these rights.

Your user content must not be illegal or unlawful, must not infringe any third party's legal rights, and must not be capable of giving rise to legal action whether against you or us or a third party (in each case under any applicable law).

You must not submit any user content to the website that is or has ever been the subject of any threatened or actual legal proceedings or other similar complaint.

We reserve the right to edit or remove any material submitted to our website, or stored on our servers, or hosted or published upon our website.

(a)to the extent that the website and the information and services on the website are provided free-of-charge, we will not be liable for any loss or damage of any nature;

(b) we will not be liable for any consequential, indirect or special loss or damage;

(e)our maximum liability in relation to any event or series of related events will be limited to £100.00.

Without prejudice to our other rights under these terms and conditions, if you breach these terms and conditions in any way, we may take such action as we deem appropriate to deal with the breach, including suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or bringing court proceedings against you.

These terms and conditions will be governed by and construed in accordance with English law, and any disputes relating to these terms and conditions will be subject to the non-exclusive jurisdiction of the courts of England and Wales.
